Form I-9 COVID-19 Flexibility Policy has Ended
All applicable I-9 documentation must be re-viewed by August 30, 2023.
In March 2020, the U.S. Department of Homeland Security (DHS) and U.S. Immigration and Customs Enforcement (ICE) introduced the COVID-19 I-9 flexibility policy, allowing virtual inspections of employee documentation for Section 2 completion. This policy has been extended multiple times, but it has officially ended as of July 31, 2023.
Employers must now resume physical reviews of I-9 documentation for new employees as of August 1, 2023, and re-view any documents originally inspected virtually by August 30, 2023.
